1. Scope and Contracting Parties

1.1 These Terms of Service govern all contracts between Set IT Free Medien GmbH, Set IT Free Medien GmbH, Wehrgasse 15/3, 1050 Wien, Austria / Europe, VAT number ATU71910569, registered in the Commercial Register of the Handelsgericht Wien under FN 411756z (hereinafter "Provider"), and users of the Skreen service (hereinafter "User").

1.2 Skreen is a web-based subscription service that automatically monitors replies to public posts by Users on the Bluesky platform (operated by Bluesky Social PBC, USA), evaluates them using artificial intelligence, and automatically moderates them based on rules defined by the User.

1.3 The Provider does not accept any conflicting terms and conditions of the User unless the Provider has expressly agreed to them in writing.

1.4 These Terms apply to both consumers and businesses. Where specific provisions apply only to consumers or only to businesses, this is explicitly stated.

2. Description of Services

2.1 Scope of Service
The Provider makes available a Software-as-a-Service platform offering the following functions:

  • Automatic detection of new posts by the User on Bluesky via the AT Protocol data stream (Firehose)
  • Automatic detection of replies to those posts
  • Evaluation of replies by an AI language model based on the Provider's global rules and the User's individual rules
  • Automatic execution of moderation actions (blocking, muting, or flagging for manual review) on behalf of the User on Bluesky
  • Logging of all moderation decisions and actions in an audit log
  • Notification of the User about actions taken, via email
  • A personal dashboard for the User to review all moderation activity

2.2 What the Service Is Not and Does Not Provide
The Provider expressly states that:

  • Skreen is not a legal advisor and does not provide legal advice
  • Use of the service does not replace legal advice and does not guarantee legally compliant conduct
  • Absolute real-time moderation cannot be guaranteed; between a reply appearing and a moderation action being taken, seconds to minutes may pass during which the reply may be visible to others
  • AI-based evaluation does not achieve 100% accuracy; false positives and false negatives are an inherent characteristic of the system
  • The service depends on the availability and terms of the Bluesky platform and may be limited or interrupted by changes to the Bluesky API or policies
  • The Provider accepts no responsibility for content that appears or has appeared in the User's reply section despite an active subscription

2.3 Moderation Policy Document
The service generates a moderation policy document based on the User's configured rules. This document serves to document the User's moderation practice. It does not constitute a legally binding agreement with third parties and has not been reviewed by a lawyer.

3. Contract Formation and Registration

3.1 The contract is formed through the User's registration on the platform, connection of a Bluesky account, and completion of a paid subscription.

3.2 The User must be of legal age and have full legal capacity.

3.3 Connection of a Bluesky account is mandatory before a subscription can be taken out. A subscription cannot be completed until a Bluesky account has been successfully linked and verified.

3.4 Per Bluesky account (identified by the permanent DID identifier of the AT Protocol), the introductory offer under Section 6.2 may only be redeemed once, regardless of whether the account is linked to a different user account.

3.5 Businesses using the service for commercial purposes must indicate this during registration and provide their VAT identification number.

4. User Obligations

4.1 Bluesky App Password
The User provides the Provider with a valid Bluesky App Password (a restricted access token provided by Bluesky for third-party applications). The App Password is stored encrypted. The User is obligated to:

  • Keep the App Password current and promptly provide a new App Password if it is changed or revoked
  • Ensure the App Password is valid and has sufficient permissions to carry out moderation actions on Bluesky
  • Inform the Provider immediately if the App Password has been compromised

4.2 Moderation Rules
The User is solely responsible for the content and legality of their individual moderation rules. Rules must not be discriminatory, unlawful, or abusive.

4.3 Prohibited Uses
The User must not use the service to:

  • Unlawfully block or harass other persons
  • Use the service in an automated manner beyond its intended scope
  • Circumvent security mechanisms

4.4 Contact Details
The User is obligated to maintain a valid email address, as notifications and invoices are delivered exclusively by email.

5. Subscription, Quotas, and Term

5.1 Subscription Plans
The service is offered in various monthly subscription plans differentiated by the number of replies that can be processed per billing period. Current plans and prices are available on the pricing page.

5.2 Quota and Quota Exhaustion
Each plan includes a monthly quota of processable replies. When 80% of the quota is reached, the User is notified by email. When the quota is fully exhausted, automatic moderation is paused. Incoming replies continue to be logged without moderation action, so the User can review missed events in the dashboard. Moderation resumes automatically at the start of the next billing period.

5.3 Plan Changes

  • Upgrade: A change to a higher plan takes effect immediately. The prorated price difference for the current billing period is charged immediately.
  • Downgrade: A change to a lower plan takes effect at the start of the next billing period. Until then, the current plan and quota remain unchanged. The new lower plan and quota apply from the next billing period, which begins with a reset counter.

5.4 Term and Renewal
Subscriptions are concluded on a monthly basis and renew automatically for successive monthly periods unless cancelled before the end of the current billing period. The User is expressly informed of this automatic renewal at the time of contract formation.

5.5 Cancellation
The User may cancel their subscription at any time via the customer portal. Cancellation takes effect at the end of the current billing period. No refund is made for the unused portion of the period unless required by law.

6. Prices, Payment, and Invoicing

6.1 Prices
All prices are stated in euros. The prices shown on the website are final consumer prices and already include statutory Austrian VAT (20%). For businesses with a valid VAT identification number from another EU member state, the reverse charge mechanism applies: no Austrian VAT is charged, which reduces the amount actually payable accordingly, and the recipient accounts for VAT in their own member state. For Users outside the European Union, no Austrian VAT is charged either. The price actually payable is determined automatically at checkout based on the User's billing country and business status.

6.2 Introductory Offer
New customers subscribing to the Starter plan for the first time receive the first month at a significantly reduced introductory price. This offer applies once per Bluesky account (DID). From the second month onwards, the regular monthly price of the chosen plan is charged. The User is expressly informed of this automatic price change at the time of contract formation.

6.3 Payment Processing
Payment processing is handled by Stripe (Stripe Payments Europe, Limited, 1 Grand Canal Street Lower, Grand Canal Dock, Dublin, Ireland). By completing a subscription, the User also accepts Stripe's terms of service.

6.4 Invoicing
The Provider issues an invoice compliant with Austrian VAT law for each payment. Invoices are delivered by email and available for download in the user dashboard.

6.5 Price Changes
The Provider reserves the right to change subscription prices. Existing Users will be notified of price changes by email at least 30 days before they take effect. The price change applies from the first billing period beginning after the notice period expires. If the User does not accept the price change, they may cancel their subscription before the change takes effect.

7. Right of Withdrawal for Consumers

7.1 Consumers generally have a statutory right of withdrawal of 14 days.

7.2 Express consent to immediate performance: The consumer expressly agrees that the Provider begins performance of the contract before the expiry of the withdrawal period. The consumer acknowledges that they thereby lose their right of withdrawal once the contract has been fully performed. Where performance is not yet complete, a proportionate right of withdrawal remains.

7.3 Businesses have no right of withdrawal.

8. Availability and Maintenance

8.1 The Provider strives for high availability but does not guarantee uninterrupted service. Scheduled maintenance will be announced in advance where possible.

8.2 The service depends on the availability of the Bluesky platform and the AT Protocol data stream. Outages or limitations on Bluesky's side do not give rise to liability on the part of the Provider.

8.3 The Provider is entitled to temporarily interrupt the service to carry out necessary maintenance or updates.

9. Limitation of Liability

9.1 The Provider is liable without limitation only for damages caused by intent or gross negligence by the Provider, its legal representatives, or agents. For ordinary negligence, the Provider is liable only for breach of material contractual obligations, and only for foreseeable, typical damages.

9.2 No liability for AI decisions: The Provider accepts no liability for damages arising from incorrect, incomplete, or unwanted moderation decisions by the AI, unless caused by gross negligence on the part of the Provider.

9.3 No liability for platform changes: The Provider accepts no liability for service limitations or outages caused by changes to the Bluesky API, Bluesky's terms of service, or technical issues at Bluesky.

9.4 No legal advice: The Provider accepts no liability for the service excluding or reducing the User's legal liability under applicable law. The service does not replace legal advice.

9.5 The above limitations do not apply in cases of injury to life, body, or health, or in cases of fraudulently concealed defects.

9.6 For consumers, mandatory statutory liability provisions apply to the extent that consumer protection law requires.

10. Data Protection

The processing of personal data is carried out in accordance with our Privacy Policy, which forms an integral part of these Terms and is available on the website.

11. Intellectual Property

11.1 All rights in the platform, source code, design, and content of the service remain with the Provider or its licensors.

11.2 The User is granted a non-transferable, non-exclusive right to use the service within the scope of the subscription taken out.

12. Amendments to These Terms

12.1 The Provider reserves the right to amend these Terms. Amendments will be communicated to the User at least 30 days before they take effect, by email.

12.2 If the User does not object to the amended Terms within 30 days of receiving the notification, the amended Terms are deemed accepted. The Provider will expressly draw attention to this consequence in the notification.

12.3 If the User objects, both parties have the right to terminate the contract at the earliest possible date.

13. Final Provisions

13.1 Governing Law: Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers, this is subject to any mandatory provisions of the law of the country in which the consumer is habitually resident.

13.2 Jurisdiction: For disputes with businesses, Vienna is agreed as the place of jurisdiction. For consumers, the statutory place of jurisdiction applies.

13.3 Severability: Should individual provisions of these Terms be or become invalid, this does not affect the validity of the remaining provisions.
